As a consequence, the customer recognizes he is perfectly aware that his agreement on the content of the present terms and conditions does not require the handwritten signature of this document, given that the customer wants to order online the products presented within the framework of the website’s store. The customer is free to save or publish the present terms and conditions, while it is made clear that both saving and publishing this document come within his own responsibility.
1. Wholeness
The present terms and conditions state the wholeness of the parties’ obligations. Thus, the customer is considered to accept without reserve the wholeness of the measures provided for in these terms and conditions. No general or specific condition stated in the documents sent or handed in by the customer will integrate to the present ones, insofar as these documents are discrepant with these terms and conditions.
2. Purpose
The purpose of the present terms and conditions is to delimit the rights and obligations of the parties within the framework of the online sale of goods and services proposed by ETHICOMUNDO to the customer.
3. Effectiveness – Duration
The present terms and conditions come into force at the date when the order form is signed. The present terms and conditions are effective for the necessary duration to provide the subscribed goods, until the extinguishment of the guarantees due by ETHICOMUNDO.
4. Information about the products
4.a ETHICOMUNDO displays on their website the products for sale with the necessary characteristics to respect the Article L 111-1 of the French Code de la consommation (Consumer Code), which provides for the customer’s ability to know the main characteristics of the products he wants to buy before the final order.
4.b The offers presented by ETHICOMUNDO are only valid while stocks last.
5. Price
The prices are in Euros and are only valid at the date when the customer sends the order form. They do not include the delivery cost, as this is an extra charge indicated before the order validation. The prices include the VAT applicable at the day of the order.
6. Payment
The customer can pay by credit/debit card with our partner PAYPAL or by bank transfer.

7. Products availability
The order will be filled within three days at the latest from the day after the one when the customer places his order. In case the ordered product is unavailable, due to our suppliers for example, the customer will be informed at the earliest possible time and will be able to cancel his order. The customer will have the choice to ask either a refund within the 30 days at the latest following the payment, either an exchange, or a credit note, which amounts to the cost of the unavailable product.
8. Delivery terms
For French destinations, the packages are sent by Colissimo Access (without signature). This post service enables a 48h delivery everywhere in France. The packages are handed in or left in your mailbox if they fit. If you are not at home when the deliverer comes, the package is left at your usual Post Office and a calling card is left in your mailbox. Then you have 15 days to pick up your package with the calling card or the package number you will have received by email.
For other European countries, the packages are sent by Colissimo Expert International against signature.
When your package leaves our warehouse, we send you the order number by email, so you can get shipment-status tracking information via the website www.coliposte.net.
9. Delivery problems
Post-related delivery delays
ETHICOMUNDO cannot be held responsible for the post-related delivery delays and no compensation request will be considered.
Damaged package
If the package, handed-in to you or left in you mailbox, is battered and shows an important risk for the products inside to be damaged, you must imperatively go to your Post Office and ask for a damage report. You have to do it that very day, without opening the package; otherwise the Post Office will refuse to deliver this report.
Package return for « NPAI » (incorrect address)
If the package we sent you is sent back to us marked NPAI (French acronym for « does not live to the mentioned address »), we will inform you the very same day. Depending on your choice, either we will give you a credit note that will amount to the order sum, delivery costs excluded, or we will send it again after correcting the address. In this case, you will have to pay the delivery costs again.
Non-collected parcels
If you are not at home when your package is delivered, it is left at the Post Office; then you have 15 days to pick it up. Beyond this deadline, the Post Office sends it back to us. In this case, we will inform you the very same day. Depending on your choice, either we will give you a credit note that will amount to the order sum, delivery costs excluded, or we will send it again. In this case, you will have to pay the delivery costs again.
Unreceived package – “lost”
The Colissimo service is reliable; however, as with every delivery service there may be delays or package losses. In case you do not receive your package 8 working days after you receive the email with the order number, we will ask you to inform us by email or phone call. Then we will get in contact with the Post claim service. An investigation will be carried out by their service. If the package is found during the investigation, it will be directly sent to your delivery address. If the package is not found after the 21-day investigation, we will send you your order again without any charge for you, depending on the products availability.
Unreceived package – « delivered »
Your order is marked « delivered » on the website coliposte.net but you still have not received it. In most of cases, the package has been accepted by a relative, a neighbour or left in your building’s « parcels » box. If this is not the case, you have to present a claim to the Post. We may help you in your procedure but we cannot be held responsible for the non-reception of the package. In case the package is considered to be « delivered », no compensation or replacement will be made.
10. Products guarantee
According to the article four of the French decree n°78-464 of March 24th 1978, the measures of the present terms and conditions cannot deprive the customer of the legal guarantee under which the professional seller is forced to protect the consumer from the consequences of the sold product’s hidden defects. The client is explicitly informed that ETHICOMUNDO association does not produce the products presented in the framework of the website, according to the French act n° 98-389 of May 19th 1998 relating to the responsibility for faulty products. ETHICOMUNDO cannot be held responsible for the damages of all kinds, material, immaterial or corporal, which could result from a malfunction or an inappropriate use of the sold products. The same occurs for the possible changes operated to the products by the producers.
In any case, ETHICOMUNDO’s responsibility will be limited to the amount of the order and would not be implicated for mere errors or omissions that could have remained in spite of all the precautions taken for the product presentation.
11. Right of revocation
The customer has 7 working days to send back, at his own expenses, the products he does not want to keep, given that this period starts from the day of his order delivery. Any return will have to be previously reported to ETHICOMUNDO’s Customer Service. The product will have to be sent by registered Colissimo to:

This right of revocation does not imply any penalty, except the return fees. In the event of the exercise of this right of revocation, the customer has the choice to ask a refund, an exchange or a credit note. For the exchanges, the sending will be at the customer’s expenses.
In the case of the exercise of the right of revocation, ETHICOMUNDO will do their best to refund the customer within 30 days.
12. Applicable law
In case of difficulty in the application of the present contract, the customer and ETHICOMUNDO retain the possibility, before any legal procedure, to seek an amicable solution.
In the absence of such an agreement, the present terms and conditions are regulated by the French law. Any litigation related to the relations between ETHICOMUNDO and the customer is subject to the exclusive competence of French jurisdictions.
13. Data protection
The data that the customer is asked to provide are necessary to process his order and may be transmitted to ETHICOMUNDO association’s contract partners who intervene in the execution of this order. The customer can write to ETHICOMUNDO association to oppose to this transmission of data, or to exercise his rights of access and rectification of his data, inscribed in the ETHICOMUNDO association’s files under the conditions set out by the Data Protection Act of January 6th 1978. The association’s database is declared to the CNIL (French Commission for data protection).
